Welcome to EliteArk. By accessing or using EliteArk.com, our Discord community, servers, store, app, or any related services operated by EliteArk LLC, you agree to these Terms of Service. If you do not agree to these terms, please do not use our services.

1. Overview

EliteArk LLC provides online gaming servers, community features, digital services, in-game perks, memberships, and related content for players of ARK: Survival Ascended and/or other supported games.

EliteArk LLC is an independent, unofficial gaming community. EliteArk LLC is not affiliated with, endorsed by, sponsored by, approved by, or officially connected to Studio Wildcard, Snail Games, ARK: Survival Ascended, ARK: Survival Evolved, Microsoft, Sony, Steam, Epic Games, or any other game publisher, platform, or trademark owner unless specifically stated in writing.

All game names, trademarks, logos, and related assets belong to their respective owners.

2. Eligibility

By using EliteArk services, you confirm that you are at least 13 years old or have permission from a parent or legal guardian. If you are using our services on behalf of another person or organization, you confirm that you have authority to accept these terms on their behalf.

3. Accounts and User Responsibility

You are responsible for maintaining the security of your game account, Discord account, website account, and any login credentials used to access EliteArk services.

You agree not to:

  • Share access to restricted accounts or services.
  • Impersonate another player, staff member, or organization.
  • Attempt to bypass bans, suspensions, or restrictions.
  • Exploit bugs, glitches, or unintended server mechanics.
  • Use cheats, hacks, scripts, bots, duping methods, macros, or unauthorized third-party tools.

EliteArk LLC reserves the right to suspend, restrict, or permanently ban accounts or users that violate these terms, server rules, Discord rules, community guidelines, or payment policies.

4. Server Rules and Community Conduct

All players must follow EliteArk server rules, Discord rules, and any posted community guidelines. Rules may vary by server type, season, map, tribe limit, event, or wipe cycle.

EliteArk LLC may update rules at any time to improve balance, protect the community, prevent abuse, or respond to game updates.

Toxic behavior, harassment, threats, hate speech, doxxing, real-life threats, chargeback abuse, staff harassment, or attempts to harm the community may result in removal from EliteArk services without refund.

5. Digital Purchases, Perks, and Memberships

EliteArk LLC may offer digital items, memberships, ranks, kits, lootboxes, boosts, cosmetics, convenience perks, or other in-game benefits.

All purchases are for digital access, entertainment, and support of the EliteArk community. Digital items have no real-world cash value and cannot be exchanged, transferred, redeemed, or sold for money unless explicitly allowed by EliteArk LLC.

Purchases do not guarantee:

  • Permanent access to any server.
  • Protection from wipes, bans, rollbacks, crashes, bugs, exploits, or balance changes.
  • Specific game outcomes, raid protection, tribe success, ranking, rewards, or competitive success.
  • Continued availability of a specific item, perk, feature, server, map, or game mode.

EliteArk LLC may change, adjust, replace, remove, or rebalance digital items, perks, kits, lootboxes, memberships, rewards, or server features at any time.

6. No Refund Policy

Due to the digital nature of EliteArk services, all purchases are final and non-refundable once completed, delivered, activated, redeemed, or made available.

Refunds will not be provided for:

  • Server wipes or seasonal resets.
  • Player bans, suspensions, or rule violations.
  • Game updates, mod updates, or balance changes.
  • Server downtime, crashes, bugs, exploits, or rollbacks.
  • Buyer’s remorse.
  • Failure to read item descriptions, rules, requirements, or limitations.
  • Changes to game balance, item availability, server settings, game modes, or features.

EliteArk LLC may, at its sole discretion, offer store credit, replacement items, compensation, or other accommodations, but is not required to do so.

7. Chargebacks and Payment Disputes

If you file a chargeback, payment dispute, or claim after receiving or accessing digital goods or services, EliteArk LLC reserves the right to suspend or permanently ban your access to EliteArk servers, stores, Discord, website accounts, app access, and related services.

Fraudulent, abusive, or improper chargebacks may be contested with proof of purchase, delivery records, server logs, account activity, IP logs, Discord logs, store records, and acceptance of these Terms of Service.

8. Server Availability and Changes

EliteArk LLC works to maintain stable and enjoyable servers, but we do not guarantee uninterrupted access.

Servers may be restarted, wiped, changed, merged, removed, updated, renamed, rebalanced, or reconfigured at any time. Game updates, hosting issues, mod issues, attacks, bugs, exploits, maintenance, or technical problems may affect availability.

EliteArk LLC is not responsible for lost items, lost progress, lost characters, lost dinos, lost bases, missed events, missed rewards, or gameplay interruptions caused by server issues, game bugs, third-party services, player actions, exploits, or technical failures.

9. Wipes, Rollbacks, and Data Loss

EliteArk servers may have scheduled or unscheduled wipes, seasonal resets, emergency rollbacks, data corrections, or progress resets.

By playing on EliteArk, you understand that ARK servers are subject to technical issues, game bugs, exploits, crashes, corrupted data, and balance changes. EliteArk LLC does not guarantee restoration of lost progress, items, dinos, structures, characters, purchases, rewards, or event placements unless we choose to do so at our sole discretion.

10. Events, Giveaways, and Rewards

EliteArk LLC may host events, contests, giveaways, leaderboards, tournaments, bounties, or reward programs.

Event rules may be changed, paused, canceled, or adjusted at any time. Rewards may be limited, substituted, denied, delayed, or removed if abuse, cheating, exploitation, rule violations, suspicious activity, or technical issues are found.

Participation in events does not guarantee winning, payment, prizes, rankings, rewards, or compensation.

11. User Content

By submitting messages, screenshots, videos, clips, feedback, suggestions, logos, names, designs, tribe names, player names, or other content to EliteArk, you grant EliteArk LLC permission to use, display, repost, edit, store, and share that content for community, promotional, moderation, security, or operational purposes.

You are responsible for ensuring you have the right to share any content you submit.

12. Intellectual Property

All EliteArk branding, logos, website content, graphics, server names, community materials, original designs, custom systems, written content, and related materials are owned by or licensed to EliteArk LLC unless otherwise stated.

Game assets, trademarks, logos, names, and related content for ARK: Survival Ascended, ARK: Survival Evolved, Studio Wildcard, Snail Games, and other third parties belong to their respective owners. EliteArk LLC makes no claim of ownership over third-party game assets, trademarks, or intellectual property.

13. Prohibited Activities

You agree not to:

  • Attack, disrupt, exploit, or interfere with EliteArk systems.
  • Attempt to gain unauthorized access to servers, databases, admin tools, store systems, staff tools, or accounts.
  • Use cheats, hacks, bots, macros, scripts, dupes, exploits, or unauthorized automation.
  • Sell, trade, transfer, or resell EliteArk digital items outside approved systems.
  • Harass, threaten, dox, abuse, or impersonate staff or community members.
  • Evade bans or create alternate accounts to bypass restrictions.
  • Abuse refunds, chargebacks, support systems, reporting tools, or moderation systems.
  • Misrepresent EliteArk LLC, its staff, services, servers, or community.

Violations may result in permanent removal from EliteArk services without refund.

14. Third-Party Services

EliteArk LLC may use third-party platforms and providers, including but not limited to Discord, payment processors, hosting providers, game platforms, store providers, analytics tools, moderation tools, and communication services.

Your use of those third-party services may also be subject to their own terms and policies. EliteArk LLC is not responsible for outages, restrictions, fees, errors, data loss, bans, account actions, or service interruptions caused by third-party providers.

15. Disclaimers

EliteArk services are provided “as is” and “as available.” We make no guarantees that services will be error-free, uninterrupted, secure, compatible, or available at all times.

We do not guarantee any specific gameplay experience, server population, item availability, event outcome, player ranking, competitive result, reward, or continued access to any feature.

16. Limitation of Liability

To the fullest extent allowed by law, EliteArk LLC, its owners, officers, staff, moderators, contractors, partners, and affiliates are not liable for any indirect, incidental, special, consequential, punitive, or other damages related to your use of EliteArk services.

This includes, but is not limited to, loss of game progress, lost digital items, lost accounts, account restrictions, server downtime, missed events, payment issues, third-party service interruptions, or community-related disputes.

17. Termination

EliteArk LLC may suspend, restrict, or terminate your access to any EliteArk service at any time, with or without notice, if we believe you violated these terms, community rules, server rules, payment policies, law, or caused harm to the community.

Termination does not entitle you to a refund.

18. Changes to These Terms

EliteArk LLC may update these Terms of Service at any time. Updates will be posted on this page with a new effective date. Continued use of EliteArk services after changes are posted means you accept the updated terms.
